Question: Consensual sex but male connivingly removes condom.? Rape.?
If a woman agrees to have protected intercourse. During the course of sex (change of position), the male removes the condom without the females knowledge or consent.

After the act, the woman has discovered what happened. Does this qualify as assault if not rape.?

I'm having this discussion with a friend who believes the woman has no recourse in this situation. I believe otherwise, but I am not sure what consequences the perv would face.Health Question & Answer

i would say that it is not rape as the sex is consensual. but then again it was only consensual if a condom was used. if the guy has STD's then i reckon it is a form of assault as he is knowingly exposing someone to disease. as far as i know though it is illegal to have unprotected sex with someone if one of the people has HIV and have not told the other person. i think someone can be prosecuted in that case.Health Question & Answer

Similar thing happened to me.
I once agreed to have sex with this girl without a condom.
We even discussed condoms right before the sex took place.
I made it clear I didn't like them, and didn't want to use one.
I didn't even have one with me!

Then, without informing me, and without my consent, she put a condom on me. (The room was dark, and she did it, well, let's just say "without using her hands".) I had no idea she had done this to me, until after it was all over.

I was pretty upset about it at the time, but I'd never thought of it as "RAPE". Now, after reading all of the answers to your very thought provoking question here, I realize that I was, in fact, raped by this woman.

While this is definitely morally wrong, I don't think she can legally do anything about it. It would be nearly impossible to prove as the man could say that he didn't realize the condom was off, etc. If he did this to intentionally infect her with an STD, such as HIV, then she could potentially have some legal recourse, if she became infected as a result of the encounter.
