Broken file....dental negligence?!

Question: Broken file....dental negligence.?
If a dentist who performed a root canal leaves a broken file in your roots and DOES NOT inform you, is this negligence.? I discovered 6 months after having severe pain with a trip to a different dentist. She reffered me to endo to have it removed. I showed the dentist and he denied it and would not cover the cost of the endo to remove it. I have gone to the dental bored, but they advised they can only discipline the dentist. Can I sue the guy.? Ethically he is dirt in my book and caused me lots of pain and suffering. Time to make him suffer.? Any idea how much something like this is worth.? No Im not greedy, just an honest everyday person who got screwed over by a quack who denies everything and the dental board agrees.Health Question & Answer

Yes, see an attorney, many of them are paid only if they win, so they will know quite quick if you would win or not, which I believe you would. This is negligence, since a dentist is required to take an x-ray after a root canal is completed, and he should have and he should have seen THAT DAY that a file was still in there. If he didn't follow this procedure, he is negligent, and is responsible for your pain and bills.Health Question & Answer

You have every right to have the endodontist's fee covered. I wouldn't go for more (like pain and suffering), since he and his insurance company are more likely to fight it and try to deny you anything.

Get a consultation with an attorney to check out your options. Lots will give you a half-hour for free. The quack has insurance that will cover this; he's only looking out for himself here and I really believe you should take him to task. Health Question & Answer
