Question: Woman suffers from broken femur in nursing home.?
90 year old woman in nursing home, that cannot walk, and is not able to move around much in bed, has a broken femur bone, staffs only answer is they dont know what happened to cause it. They neglected to call the family to let them know she was in the hospital, but the family did get a call from the emergency doctor. I think it is so slack that someone could hurt someone and not report it...I am thinking about sueing their butts, what do you thinkHealth Question & Answer

whoever is listed as having her limited power of attorney at the nursing home should have been notified. lack of notification does not imply abuse or neglect but rather a lack of follow up. the fact is the elderly and in particular those who are bedridden are more susceptible to broken bones and it is not always immediately obvious. contact the nursing director and ask for some clarification and if you are not totally comfortable with their response and plans for improvement contact the facilities Ombudsman (there is contact information posted near the front of the facility).
you can contact your states department of human services to file a complaint if you feel it is warranted.

This is called lack of Standard of Care. That is the care expected to be provided by any medical provider.
The ER should fill out a report, the report filed with the state registry of nursing homes, exactly about not reporting this when it happened.
The Nursing Home is trying to pass off this event, it must be reported legally, as an elderly person has been injured (intentionally or not.?) a report must be filed, this is why the ER reported the incident.Health Question & Answer

Something very similar happened to my grandmother several years ago while she was living at a nursing home. She had Parkison's Disease for many years and found it difficult to communicate, but her leg was really bothering her. After seeing the doctor, it was discovered that she had a broken femur. The people at the nursing home did not report it or even take her to the hospital, but nothing was for sure. I suggest you research the rights tht go along with someone in a nursing home to see if they are in fact required by law to inform you of any injuries, which I assume would in fact be the case. You have to have the facts first. Is the patient suffering from osteoporosis a common condition in older women.? In addition the nurse on duty does not have only one patient. They have (at least in my old facility) 50 patients each with timed meds. That means there may not have been time for the nurse in charge to contact the family. You don't mention the time frame so it is unclear if the EMS folks contacted the family directly the same day for the admission. That was protocol for my facility in Ohio. It was decided by the administrators that it would have been improper for the nurse in charge to contact the family directly since that was more of an administrative function and they were health care providers. That was left to the facility administrators to take care of. That of course can only happen after the hospital staff has had the opportunity to make a full examination, come up with a diagnosis, and then inform the sending facility with the information. Sadly, 90 y/o woman tend to have very brittle and easily broken bones. The fact that she broke a bone does not necessarily mean she was in any way neglected.
