Question: Advice on the mental health act in the uk only..?
Hi. I need some advice on how to get a close relative sectioned under the mental health act for their own safety and the safety of other members of our family. The person has serious mental health issues and over the years has got worse & more aggressive towards anybody and everybody and we have tried all avenues to get the person to seek help but they never follow the action up. We are all concerned but dont know what to do to help the person. if any one can give me some sound serious advice we would all appreciate it.Health Question & Answer

ring your local hospital and ask to speak to someone in the mental health department and they should be able to give you the best advice. a friend of mine went to our local hospital and got himself admitted because he was severely depressed and said he was a danger to himself and the public and needed help. im pretty sure its the mental health department you need to ask for, im rather tired so i cant remember, but you know what i mean, no doubt you've seen them sign posted at out lovley nhs hospitals, lol!

Have you tried the police.? Not the best option because a GP should be able to refer someone. However next time this person gets aggressive phone the police and they can put them in a place of safety and maybe whilst they are there the doc will section them. However the person still then has to comply with the treatment. Trouble is the police can be very jobsworth and may just put them in a cell for a while, they dont always treat ppl with mental health problems they right way, so its a risk. I think the main way this is possible is to go through your relative's G.P and let them see how serious this has become. They will contact a mental health unit and your relative will have to go for an assessment - if they see he/she is a risk to themselves or others then they will be sectioned under the mental health act for a certain amount of time depending on severity of symptoms and which section of the act they are sectioned under. You can't just have someone detained under the Mental Health Act. Detention has to be instituted by two approved doctors (one in an emergency), following which it must be sanctioned by an approved social worker. that sounds harsh to me but then i dont know you or your family so i wont judge.

You will need to see a dr personally and he/she will talk you through it. but please be aware that getting someone sectioned is a very very hard thing to do and prove, even more so if there is no record of their illness or violence.

contact there gp or you could call your local community mental health team,they are the people who will have to be involved but you will need a referal from a gp im sure,to be section a social worker and two doctors have to approave it,but relatives can defintetly ask,they will need to be seen by a psych,it could be a painfull situ for you all to go through... and believe me psch wards are not nice but if you have serious concerns then this is best, you can always call nhs direct in emergency situ and of course the police if you or them are in danger to them selves or others ,i know the police will take people to pysch wards and then they will be seen by a locum pysch or doc and if need be be put on a short section take careHealth Question & Answer

Whilst the current MHA legislation allows the possibility of a 'Nearest Relative' making an application for detention - I can tell you that in 18 years as a Mental Health Nurse I never saw this used ONCE. The application is invariably done by an 'Approved Social Worker' - alongside two medical recommendations. All I can suggest is that if you are unable to get this person to seek help - then your only recourse, in the case of violence or threatening behaviour, is to involve the police. This sounds drastic, but is often the only way that some individuals, who desperately need help, actually get it.

The GP option is a non-starter. A GP is unlikely to get involved without a request for help from the affected person.Health Question & Answer
