Can you use FMLA with hypersomnia?!


Question: Can you use FMLA with hypersomnia.?
Let me be more specific. I was just diagnosed with hypersomnia, which causes me to sleep through my alarm almost every morning. Therefore, I am late to work almost every morning. I don't want to get fired because of this condition, because I've literally tried everything and nothing works. I have three alarms, including the Sonic Boom and the Screaming Meanie, and I go to bed by 11:00 every night and nothing works. My work schedule varies every day so I wake up at a different time every morning, so I think that's part of it, but I was told to look into the Family and Medical Leave Act as something that might protect my job if I'm late because of this disorder. Is this an option I can explore, or would simply getting a doctor's note and giving that to HR suffice.? What would you recommend I do, because I'm honestly not making excuses but I do not hear my alarms in the morning and I am always late from oversleeping because I just cannot get up. My boss is on board with me on this (she was the one who suggested I get the sleep study that diagnosed this disorder) but she can't really control whether HR tells her to fire me because of my lateness. You mean American with Disabilities Act. FMLA is Family Medical Leave Act, where you legally cannot be replaced while you take leave to take care of your ill family. I would think with a doctor's note under ADA, they could not do anything to you for it. However, I am not sure what they could do for you to help though. I have had problems with the same thing and had to be scheduled to come in later because my meds do the same to me. I was being scheduled for 6am all of a sudden after being down for 10 normally and I had oversleeping problems too. I would say that it depends on the shifts they have available and you may have to be willing to have your starting time cut back a bit to work with them about it beyond what you wanted. I mean, I had to take a move to 11am shift start to make it work but it was worth it to me because I am always up in time to do that. Health Question & Answer

I must be missing something from your question - FMLA is the Family Medical Leave Act; are you planning on taking a leave from your job to investigate treatment options.? If not, then perhaps you are thinking about the ADA - Americans With Disabilities Act. I don't know if hypersomnia is considered a disability, but you can always do some research on it to find out if you are covered by the ADA.

Alternately...have you considered going to bed earlier.? Maybe hitting the sack at 11:00 is too late - especially if you are expected to wake up earlier than 7:00 a.m.Health Question & Answer

The Family Leave Act- FMLA
This is only utilized when a woman or man is in a condition that can not work for more than a month. When some one has a baby or and accident and can not possibly be able to come to work or Mental breakdowns or disorders.
You can not use this for what you are suffering with.
You need to get more sleep. Are you sleeping your 8 hours or more
for the night. Try taking something from the pharmacy that can be recommended to you by the pharmacist to help you sleep. Now remember you need to take this medication earlier than 11 o'clock
You need to reschedule your bodies clock. Once you get use to getting up late you continue to make it a habit you need to get that out of your system or you are simply going to lose your job. Human Resources is going to notice the pattern. also if you signed a job description stating that the position that you held is a position that is 8 to 5 That means that you need to be there before 8 or at 8. If you do not comply that can be reason enough to fire you. So try to deal with that you need to change your sleeping pattern try going to sleep earlier so that you feel more rested in the morning. Go to sleep early but you are going to need something to help you sleep.
