Can i sue the doctor who lied to me big time?!


Question: I took the surgery 5days ago.Doctors told me "You're going to take laparascopic surgery,it's simple and common." That was all i heard until i got in operation room. And then when i woke up from anethesia,they told me they couldn't see my overian cyst with camera,so they had to cut my body. It was major surgery.now,i have to stay home for next 6weeks to recover,i have almost 3inchcut in the middle of my belly. I don't think they try to do laparascope at all.They just lied. I feel horrible,I can't even relax. I am sure they do all the time,lie,,I talked with another patient similar case,too. What can i do about it?

Why would the doctor do a more lengthy and complex procedure--taking up more of his own time--if it wasn't necessary?

The situation changed once they had you in the OR and got a better look. The other option was to wake you up from anesthesia, tell you what happened, and then put you under anesthesia a second time to do the only thing they could have done anyway.

It's disappointing that you now have to deal with more than you were prepared for. But this is what happens in medicine. It's not like hiring a contractor.

Get a lawyer and a new doctor.
You can sue anyone for any reason provided that you can find a lawyer who will take your case. The real question is whether or not you will win the suit. That is up to the judge. Doctors have insurrance for this sort of thing because it happens so much.
Well my advice would be talk to a lawyer, if he thinks its a case that's able to be won, go for it.
call a attorney but more than likely you signed a consent to treat form and maybe should have read it first. yes it does happen all the time anyone who says diff is probably a doctor.
NO, that sort of thing does not happen at all. No doctor who wants to keep his license would do major surgery without the patient's consent. If someone started to rupture or bleed out during a laprascopic exam, and they simply had to save your life, that would be a different story.
Go over the consent form you signed, and see if it mentions the risks involved. If not, go to the hospital's risk manager, and file a complaint about the doctor.

Wow that's crazy..and totally unfair.Of course you can sue. They lied to you! We are suppose to be able tyo trust them with our lives, and here they are lying to you. You really should do something about it.
you whinning *****! what the doctor was trying to do unsuccessful so he had to try different tactics. he didn't lie to you. from what you are saying it seems the operation was successful. here is some news for you. YOU FEEL BAD AFTER ALL OPERATIONS. stop being so pathetic and be grateful that you got this medical attention.
That consent form that you sign doesn't mean anything. It is possible to still sue. I am not saying it is relevant in this case. If you feel like it is, speak to a lawyer and have them check for medical negligence. I don't think the doctor "lied" to you because like the other person said, no doctor would intentionally put themselves in a situation to lose their license. Now if the surgery could have been avoided, that could be determined by the lawyer and another medical professional that the lawyer would hire on your behalf.
Recovery from surgery sucks and there is nothing you can do about it. Although your doctor should have mentioned this line of action given the outcome prior to surgery, he was still in the right. After all, isn't it more important that the cyst is out. You should be thanking him, not suing him. Don't be one of these spontaneously suing Americans. Roll with the punches.
