Question: I'm looking for a lawyer or legal aid or a lawyer working for a cause to help me build a case for myself and perhaps others with kidney failure that went untreated or overlooked or were not sent to a specialist over time. There might be a ststue of limitation. I'm was with end stage kidney failure and never sent to a specialist by my primary DR. was even in the hosiptal not told I had any stage kidney failure, but when I went to another DR outside kaiser I was dieing. Now I'm a dialysis patient till Ican get a transplant or die waiting! So I need you to speak up and join me with my quest to help others in helping themselves before its to late for them. There is power in numbers and I've got nothing to lose by helping others or there families gain thier dignity through class action! First thing is to find the right lawyer and get your medical records!

You will need to establish a few things to build your case. First of all is you need to prove that you had labwork or something else done to prove that you had kidney (renal) disease that was not addressed. The most common tests would be a Chem 7 (specifically the BUN and serum creatinine--abbreviated SCr). This is a very basic lab test. If you can prove you had elevated BUN and SCr and the doctors overlooked it and/or did nothing about it at that time, then you have a case.

Now it's certainly possible that when you were admitted to the hospital, it could have been assumed you were being treated for it. Or it is possible that the hospital never checked a Chem-7 and you weren't symptomatic. Sometimes if you are in the hospital for only a very short amount of time, they do not do a lot of lab tests. And of course, it's certainly possible the hospital also overlooked it.

Transplants are obviously not for everyone. Generally though if you are young and otherwise healthy, you would get a bigger priority than someone who is older and has many other co-morbid conditions.

Although your case is certainly sad, it is probably pretty rare. Such a large oversight is very uncommon in medical practice. I think it would suffice that you go as an individual in your lawsuit (as opposed to class-action).
